1. About these terms
These terms are a legal agreement between you and Pathways+ Limited, a company registered in England and Wales with its registered office at 24 Beaumaris Close, Dudley, England, DY1 3LX ("Pathways+", "we", "us", "our"). They govern your access to and use of the PathwaySkills platform at pathway-skills.com and any related services ("PathwaySkills" or the "Service").
By accessing or using PathwaySkills you agree to these terms. If you do not agree, please stop using the Service.
2. Who can use PathwaySkills
PathwaySkills is designed for UK Functional Skills learners aged 16 or over studying with a registered training provider. You may only create an account if your training provider has arranged access on your behalf, or if you have been invited to do so.
Teachers and organisation managers use the Service under a separate contract between their organisation and Pathways+.
3. Your account
You are responsible for keeping your login credentials confidential and for all activity that happens under your account. You must notify us immediately at help@pathway-skills.com if you believe your account has been compromised.
You agree to provide accurate information when you register and to keep that information up to date.
4. Acceptable use
You agree not to:
- Use PathwaySkills for any unlawful purpose or in breach of these terms.
- Attempt to gain unauthorised access to any part of the Service, other accounts, or our infrastructure.
- Copy, republish, or redistribute our assessment questions, mock exams, lesson content, or other copyrighted material without our written permission.
- Use automated systems (scrapers, bots) to access the Service, except for good-faith accessibility tools.
- Submit content that is unlawful, harmful, harassing, defamatory, or otherwise offensive.
- Impersonate any person or entity.
We reserve the right to suspend or terminate accounts that breach these rules.
5. Intellectual property
All content on PathwaySkills — including but not limited to assessment questions, mock exams, lessons, software, design, and the PathwaySkills name and logo — is owned by Pathways+ Limited or our licensors and is protected by UK and international copyright, trademark, and other intellectual property laws.
You retain ownership of any content you submit (for example, your essay responses and profile information), but you grant us a worldwide, non-exclusive, royalty-free licence to use that content to operate the Service for you and report your progress to your training provider.
6. Assessment integrity
PathwaySkills delivers initial assessments, practice questions, mock exams, and other assessment material. You agree to complete these honestly and without external assistance, copying, collusion, or the use of artificial-intelligence tools unless the task explicitly permits it. We may invalidate results obtained through prohibited means and notify your training provider.
PathwaySkills does not itself award Functional Skills qualifications. Formal qualifications are awarded by registered awarding bodies following a separate end-point assessment.
7. Availability and changes
We aim to keep PathwaySkills available at all times but we do not guarantee uninterrupted service. We may change, suspend, or discontinue features, and we will give you reasonable notice before any material change that affects your learning.
8. Privacy
Your use of PathwaySkills is also governed by our Privacy Policy, which explains how we collect and use personal data and the rights you have under UK GDPR.
9. Warranties and liability
The Service is provided on an "as is" and "as available" basis. To the extent permitted by law, we exclude all implied warranties. Nothing in these terms limits our liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded under English law.
Subject to the paragraph above, our total aggregate liability to you arising out of or in connection with these terms is limited to the greater of (a) £100 and (b) the amount your training provider paid us in the twelve months before the event giving rise to the claim.
We are not liable for any indirect or consequential loss, loss of profit, loss of goodwill, or loss of data to the extent the law permits us to exclude this.
10. Termination
You may close your account at any time by contacting help@pathway-skills.com. We may suspend or terminate your access if you breach these terms, or if your training provider's contract with us ends. On termination we will handle your data in line with the retention rules in our Privacy Policy.
11. Governing law and jurisdiction
These terms, and any dispute or claim arising out of or in connection with them, are governed by the laws of England and Wales. The courts of England and Wales have exclusive jurisdiction, unless you are a consumer resident in another UK nation in which case you may bring proceedings in the courts of that nation.
